Terms of Service

By using our service, you agree to comply with these Terms.

You must be legally able to enter these Terms, and if you use the service for an organization, you represent that you have authority to bind it. The service is not directed to children under 13.

Services

We reserve the right to modify, suspend, or discontinue our services at any time, or to terminate your account for violating these Terms.

Content

You retain all rights to data you upload to the service. You are responsible for any code or data you upload. Illegal content is prohibited.

You grant us a non-exclusive license to store, process, and display your content as needed to provide, maintain, and improve the service. This includes sending your content to subprocessors as described in our Privacy Policy. By using the service you consent to that processing. You may not use the service to distribute malware, scrape or interfere with the service, or violate any law. You agree to indemnify us against claims arising from content you upload.

DMCA notices should be sent to root@hyperparam.app. We may remove allegedly infringing content and may terminate repeat infringers. If you believe content was removed in error, you may send a counter-notice as permitted by law.

Billing

We offer a free tier and paid monthly subscription plans with features and usage limits that vary by plan. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel. Subscription fees are billed in advance and are non-refundable except as required by law. You may cancel at any time, and your cancellation will take effect at the end of the current billing period. We may change plan pricing, features, or usage limits from time to time, and any changes will apply no earlier than your next billing cycle after notice to you. Changes affecting subscriptions or fees will apply prospectively as required by law.

If you exceed the usage limits for your plan, we may limit access to certain features unless and until you upgrade or the next billing period begins.

Limitation of liability

The service is provided “as is” without warranties of any kind. We are not responsible for the output of AI models. To the fullest extent permitted by law, our total liability is limited to the greater of $100 or the fees you paid to us in the 12 months before the claim.

Disputes

These Terms are governed by Washington law, excluding its conflict of laws rules. Any dispute arising from these Terms or the service will be resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules in King County, Washington, except that either party may bring an individual claim in small claims court if it qualifies. The parties waive any right to participate in a class, collective, or representative action. If that waiver is found unenforceable, this arbitration provision will be unenforceable to that extent.

Changes

We may update these Terms at any time. Continued use signifies acceptance.
